These Terms of Service ("Terms") govern your access to and use of the kaimon platform, including the website, customer portal, API, and File Integrity Monitoring agent (collectively, the "Service"). By creating an account or deploying the agent, you agree to these Terms. kaimon is operated in the United States.
You must provide accurate information when creating an account. Accounts are created via social login (Google or GitHub) through a third-party authentication provider. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old and have the legal authority to bind your organization to these Terms. You may not create multiple accounts for the same organization to circumvent subscription limits.
The Service includes the kaimon agent, an eBPF-based kernel monitoring binary that you install on your Linux endpoints. By deploying the agent, you represent and warrant that:
The agent operates in read-only mode within the kernel and does not modify, delete, or interfere with files on your systems. It captures filesystem event metadata only — it does not read file contents.
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You may not:
Paid subscriptions are billed monthly in advance through a third-party payment processor. You may upgrade, downgrade, or cancel your subscription at any time from your account settings in the portal. Upgrades take effect immediately; downgrades and cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods or unused time. Pricing is subject to change with 30 days' advance notice.
If a payment fails, your subscription enters a past-due state. If payment is not resolved within 14 days, your account may be downgraded to read-only mode until the balance is settled.
The free trial provides full access to the Service for one monitored endpoint for 14 days. No credit card is required. After the trial period, report generation stops and the portal enters read-only mode — your historical data and previously generated reports remain accessible. To restore full functionality, you must subscribe to a paid plan. Baseline suppression rules established during the trial carry over seamlessly upon conversion — no re-baselining is required.
You retain full ownership of all data collected by the kaimon agent from your infrastructure. We claim no ownership rights over your telemetry data, generated reports, or AI-produced analysis. We do not sell, share, or use your telemetry data for any purpose other than providing the Service to you. Generated reports, AI executive summaries, and compliance assessments are derived from your data and belong to you.
Agent telemetry follows an automated retention lifecycle: data is stored in hot storage for the first 60 days, transitions to cold storage from days 60–365, and is permanently deleted after 365 days. Generated reports (HTML, PDF, JSON) follow the same lifecycle. Upon account termination, your data continues through the standard lifecycle. You may request immediate deletion of all your data at any time by contacting us at hello@kaimon.co.
The Service uses large language models (LLMs) to generate baseline suppression rules and compliance report summaries. AI-generated content is provided for informational and operational purposes. While we strive for accuracy, AI outputs may contain errors or omissions. You are responsible for reviewing AI-generated reports and rules before relying on them for compliance, audit, or security decisions. The Service does not constitute legal, regulatory, or compliance advice.
You may configure webhook integrations (Slack, Discord, or custom HTTPS endpoints) to receive automated report notifications. You are solely responsible for the security, availability, and access controls of your configured endpoints. We are not liable for data exposure resulting from misconfigured or insecure webhook destinations.
We target high availability for all Service components but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance with reasonable advance notice via email or dashboard notification. We are not liable for downtime caused by factors outside our reasonable control, including but not limited to: cloud provider outages, internet connectivity issues, DNS failures, or force majeure events.
The Service — including its design, source code, eBPF agent, AI models, detection rules, compliance mappings, report templates, and documentation — is the intellectual property of kaimon and is protected by applicable copyright and trade secret laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your active subscription term.
The agent binary is licensed, not sold. Your right to install and run the agent on your systems is conditioned on maintaining an active account and your continued acceptance of these Terms. Upon termination of your subscription or account for any reason, your license to use the agent ceases and you must uninstall it from all systems.
Kernel-level operation. The kaimon agent operates within the Linux kernel via eBPF technology. You are solely responsible for evaluating whether deploying kernel-level software is appropriate for your systems and environment. You assume all risk associated with installing and running the agent on your infrastructure.
You agree to indemnify, defend, and hold harmless kaimon and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your deployment of the agent on systems without proper authorization; or (d) your violation of any applicable law or regulation.
To the maximum extent permitted by applicable law, kaimon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from or related to your use of the Service — even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total fees actually paid by you to kaimon in the twelve (12) months immediately preceding the event giving rise to the claim.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific compliance requirements, that reports will be error-free, or that AI-generated baseline rules will capture all operational noise in your environment.
You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. We may suspend or terminate your access immediately and without prior notice if you materially violate these Terms, engage in activity that threatens the security or integrity of the Service, or fail to resolve a past-due payment within 14 days. Upon termination, your right to use the Service ceases immediately. Your data will follow the standard retention lifecycle unless you request earlier deletion.
We may update these Terms from time to time. Material changes will be communicated at least 30 days in advance via email to the address associated with your account or by a prominent notice in the portal dashboard. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and cancel your subscription before the effective date.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation before either party pursues formal legal proceedings.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy, constitute the entire agreement between you and kaimon regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
